Terms of Use
1. General Provisions
These Terms govern the use of the Snap&Vibe (snapandvibe.com) website and personal account, the Telegram bot and the AI Agent. The Administration is [Company name]. By using the Service, the user accepts these Terms.
2. Registration
Sign-in is by phone number, via Telegram or via third-party accounts supported by the Service. The user is responsible for keeping access to their phone and Telegram secure and for actions performed from their account, including instructions given to the AI Agent.
3. Rights and Obligations of the User
The user undertakes to:
- provide accurate information about themselves, their services and prices;
- upload only their own photos and voice, or materials with the written consent of the persons depicted;
- not use the Service to create digital twins of other people without their consent, or for deception, fraud, unlawful advertising, insults or any other violation of the law;
- enter clients’ data into the CRM only with their consent;
- bear sole responsibility for all content created in the Service at their request: the Service is an aggregator of neural network services and creates materials on the user’s instructions (Section 6.1 of the Public Offer);
- not attempt to gain access to other people’s accounts and not overload the Service with automated requests.
Payment for generations. A generation (video, photo, post, article) is considered rendered as soon as it has been created according to your template or an approved script; money is debited from the balance for the content actually created. Edits are a new generation and are paid separately. Details are in Section 5 of the Public Offer.
Generation prices. The cost of each publication can be calculated in advance on the website: the price of a single publication and a weekly content plan. Prices in the calculator are approximate: they are updated every day according to current neural network prices and exchange rates. Before launching a generation, the Service states its price and debits money only after your consent (clause 3.2 of the Public Offer).
4. Rights and Obligations of the Administration
The Administration ensures the operation of the Service, stores data in compliance with the law, and notifies users of important changes via the personal account, email or Telegram. The Administration may suspend an account in the event of a breach of these Terms or legal requirements and may refuse to release material that violates the law.
5. Intellectual Property
The software, design and texts of the Service belong to the Administration. Materials created for the user belong to the user (Section 11 of the Public Offer). All videos and images created through the Service contain the “Snap&Vibe (snapandvibe.com)” watermark. The watermark may be removed only by agreement with the Contractor — separately for each Customer; the Contractor may refuse such a request.
6. Account Deletion
The user may delete their account by writing to [contact email]. Data, the digital twin model and the client database are deleted within 10 days, except for information that the law requires to be retained (for example, about payments).
7. Liability
The Service is provided “as is”. The Administration is not liable for lost profits or for the actions of third-party platforms. The user is responsible for the content and publication of content created at the user’s request (Section 6.1 of the Public Offer). Limitations of liability are set out in Section 12 of the Public Offer.
Videos, photos and other materials created by the Service at the user’s request are delivered to the user in Telegram or in the personal account. The Administration does not publish them itself. The user decides independently on publication and on the choice of platform and method of distribution. The Administration is not liable for the distribution of the created materials by the user or by third parties: for copying, forwarding, publication on any platforms, modification, removal of the watermark or use for other purposes. The watermark on the materials indicates the creation tool and is not advertising. The Service is a technical tool for creating content. The user bears full responsibility for where and how they publish finished materials and undertakes to comply with applicable law, including advertising law and any restrictions on the use of particular platforms.
8. Changes and Disputes
These Terms may be changed by publishing a new version. Claims should be sent to [contact email]; the response time is 10 business days. Governing law: [governing law to be specified].
